1. Agreement to Terms

By accessing or using PEEKASO ("the Service"), operated from Lagos, Nigeria, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

These Terms apply to all users including business owners, team members, and visitors. Our Privacy Policy explains how we handle your data and forms part of these Terms.

2. Description of Service

PEEKASO is an AI-powered platform that generates marketing flyers and graphics for small and medium businesses. You provide your brand information and product details; our AI creates professional flyer designs that you can download and share.

3. Account Registration

  • You must provide a valid email address to create an account.
  • You are responsible for all activity that occurs under your account.
  • You must not share your OTP code or allow others to access your account without authorisation.
  • You must notify us promptly at hello@peekaso.com if you suspect unauthorised use.
  • We reserve the right to suspend or terminate accounts that violate these Terms.

4. Tokens, Pricing & Payments

PEEKASO operates on a token-based system. Generating a flyer consumes tokens. Tokens can be acquired through free trial allocations, flyer pack purchases, or subscription plans.

  • All prices are displayed in the currency shown at checkout (default: Nigerian Naira).
  • Payments are processed securely by Paystack. We do not store your card or bank details.
  • Token purchases and flyer pack purchases are non-refundable once tokens have been credited to your account, except where required by law.
  • Unused tokens do not expire for active accounts. If your account is deleted, unused tokens are forfeited.
  • We may change pricing at any time. Active subscriptions will be honoured at their original price until renewal.

5. Acceptable Use

You agree not to use PEEKASO to:

  • Generate content that is illegal, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.
  • Create flyers that infringe on any third party's intellectual property, trademark, or copyright.
  • Impersonate another person or business, or misrepresent your affiliation with any entity.
  • Upload malware, viruses, or any harmful files.
  • Attempt to reverse-engineer, decompile, or extract our AI models, prompts, or proprietary systems.
  • Use automated scripts or bots to access the Service in a manner that exceeds reasonable use.
  • Resell, redistribute, or white-label the Service without our written consent.

We reserve the right to remove content and suspend accounts that violate these rules without prior notice.

6. Intellectual Property

6.1 Your Content

You retain ownership of all content you upload (logos, product images, text). By uploading content, you grant PEEKASO a limited, non-exclusive licence to process it for the purpose of generating your flyers.

6.2 Generated Flyers

Flyers generated by PEEKASO are yours to use for your business marketing purposes. You receive a perpetual, worldwide, royalty-free licence to use, share, print, and modify your generated flyers. You may not claim the underlying AI technology or design system as your own.

6.3 PEEKASO's Property

The PEEKASO name, logo, design templates, AI models, software, and all related intellectual property belong to us. These Terms do not grant you any rights to our brand assets or technology beyond using the Service as intended.

7. AI-Generated Content Disclaimer

PEEKASO uses artificial intelligence to generate flyer designs. While we strive for high quality, AI outputs may occasionally contain errors, unexpected results, or imperfections. You are responsible for reviewing all generated flyers before publishing or distributing them.

We do not guarantee that AI-generated designs will be free from similarities to existing designs or that they will meet specific legal requirements for your industry.

8. Team Accounts

Account owners can invite team members to create flyers under their brand. The account owner is responsible for their team members' compliance with these Terms. Team members' access can be revoked at any time by the account owner.

Team usage counts against the account owner's token balance and daily limits.

9. Service Availability

We aim to keep PEEKASO available 24/7 but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any losses resulting from downtime.

10. Limitation of Liability

To the maximum extent permitted by law, PEEKASO and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to lost profits, data loss, or business interruption.

Our total liability for any claim arising from the Service shall not exceed the amount you have paid to PEEKASO in the 12 months preceding the claim.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Account Termination

  • You may delete your account at any time from your Account settings or by emailing us.
  • We may suspend or terminate your account for violations of these Terms, fraudulent activity, or extended inactivity (12+ months with no login).
  • Upon termination, your access to the Service ceases. We will delete your personal data in accordance with our Privacy Policy.

13. Governing Law & Disputes

These Terms are governed by the laws of the Federal Republic of Nigeria. Any disputes arising from these Terms or the Service shall first be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the jurisdiction of the courts in Lagos, Nigeria.

14. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or through the app at least 14 days before they take effect. Continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
